Transfer

HOW CAN THE TRANSFER BE MADE?

HOW MANY TYPES OF TRANSFER ARE THERE?  

- in the interest of the civil service
- at the request of the civil servant

 WHAT POSITION QUALIFIES FOR TRANSFER?
- a vacant civil service position of same level, respecting the category, class and professional grade of the civil servant
- a vacant civil service position of a lower level
· for civil servants, execution/operational level: the civil service with a higher professional grade lower than the professional grade of the civil service held or of lower level
· for the civil servants, management level : the public civil service position hierarchically located at a lower level of the public function held, as well as any public execution function

  WHICH ARE THE CONDITIONS THAT SHOULD BE FULFILLED FOR THE TRANSFER?
- the transferred civil servant must have the level of studies required, the conditions of seniority and the specific conditions for the occupation of the public position in which he is to be transferred
- the leader of the public authority or institution to which the public official is transferred verifies the conditions for carrying out the transfer

INFORMATION on the TRANSFER IN THE INTEREST OF THE CIVIL SERVICE:
- with the approval of the head of the public authority or institution in which the civil servant is to perform his activity
- with the written agreement of the civil servant
- with the approval of the head of the public authority or institution in which the civil servant is to perform his activity
- in the case of the transfer in the interest of the service in a locality other than the one in which the authority or public institution from which it is based is located, the transferred civil servant has the right to:
· Allowance equal to the net salary calculated at the level of the salary from the month previous to the one in which it is transferred
· Paid leave of 5 working days
· The payment of these rights is supported by the public authority or institution to which the transfer is made, within 15 days from the date of approval of the transfer
· The civil servants who have their domicile in the locality in which the authority or public institution to which they are transferred, do not benefit from the right to compensation

TRANSFER  INFORMATION ON REQUEST:

- is made at the request of the civil servant
- with the approval of the head of the public authority or institution in which the civil servant is to perform his activity
- the public authority or institution within which the transfer on request of the civil servant has been approved, shall promptly notify the public authority or institution in which the civil servant carries out his activity, regarding the approval of the transfer request
- within a maximum of 10 working days from receiving the notification, the head of the public authority or institution in which the civil servant carries out his activity has the obligation to issue the administrative document amending the civil servant's service reports, specifying the date from which the transfer to application
- the date from which the transfer on demand operates cannot exceed 30 calendar days from the date of issuing the administrative document.

Public authorities or institutions may approve internal procedures for the selection of civil servants by transfer, respectively of verification of the conditions for carrying out the transfer.
