WHAT IS THE CIVIL SERVICE ?
The civil service represents the set of duties and
responsibilities, established under the law, for the purpose of exercising the
prerogatives of public power by the public authorities and institutions.
WHAT ARE THE DIFFERENT TYPES OF CIVIL SERVICES?
State civil
services are the civil services established, according to the law, within:
- ministries
- specialized
bodies of central public administration (eg: agencies, authorities etc.)
- specialized structures of the Presidential
Administration (ex. .: Chancellery of the Orders)
– specialized structures of the Parliament of Romania
- autonomous public authorities provided in the
Constitution of Romania and other autonomous administrative authorities, as
well as within the structures of the judicial authority
Territorial civil services are the established civil services,
according to law, within:
- prefect
institution
- decentralized public services of ministries and
other central public administration bodies in administrative-territorial units,
as well as public institutions in the territory, subordinated / co ordering /
under the authority of the Government, the ministries and other bodies of the
central public administration (eg: directions, agencies, etc.)
Local civil services are the public functions established, according to
the law, within:
- their own apparatus of the
authorities of the local public administration and of the public institutions
subordinated to them (eg: mayors, county councils, local public services -
taxes and fees, records of persons etc.)
WHAT CONDITIONS MUST BE FULFILLED TO OCCUPY A CIVIL SERVICE POSITION?
- Romanian citizenship and domicile
in Romania;
- knowledge of the Romanian language, written and spoken;
- the age of at least 18 years old;
- full exercise capacity;
- apt from a medical and psychological point of view to exercise a civil
service job. The certification of the state of health is made on the basis of a
specialized medical examination, by the family doctor, respectively on the
basis of psychological evaluation organized through specialized units accredited
under the conditions of the law;
- the fulfillment of the conditions of studies and seniority in specialty
provided by the law for the occupation of the civil service job;
- the fulfillment of the specific conditions, according to the job description,
for the occupation of the civil service position;
- has not been convicted of a crime against humanity, against the state or
against authority, corruption or service crimes, crimes that prevent the
execution of justice, criminal offenses or a crime committed with intent that
would make it incompatible with the exercise the public service, except for the
situation in which the rehabilitation, the post-conviction amnesty or the
decriminalization of the act took place;
- they were not forbidden the right to occupy a public service job or to
exercise the profession or activity in the execution of which committed the
deed, by definitive court decision, according to the law;
- was not dismissed from a civil service law or did not terminate his
individual employment contract for disciplinary reasons during the last 3
years;
- he was not a worker of the Security or his collaborator, under the conditions
provided by the specific legislation.
* If, among the specific conditions, the obtaining of a notice / authorization
/ stipulated by the law is established, this condition is fulfilled in
compliance with the provisions of the specific legislation regarding the
fulfillment of the condition.
* In order to occupy the management positions, the candidates must be graduates
with a diploma of the master's degree studies in the field of public
administration, management or in the specialty of the studies necessary to
occupy the civil service job or with an equivalent diploma according to the
provisions of art. 153 para. (2) of the National Education Law no. 1/2011, as
subsequently amended and supplemented.
* By exception, the public management positions from the level of the local
public administration authorities organized at the level of the communes and
the cities can be occupied, by competition organized according to the law, by
persons who have university degrees graduated with diploma, respectively higher
studies of long duration graduates with a bachelor's degree or equivalent or
higher studies of short duration, graduated with a diploma, in the specialty of
the studies necessary to occupy the civil service.
WHAT ARE THE MINIMUM SENIORITY CONDITIONS
IN THE SPECIALTY OF THE STUDIES NECESSARY TO OCCUPY A CIVIL SERVICE
POSITION?
Execution position
· one year for the execution of public functions of the assistant professional
degree
· 5 years for the execution of the public execution functions of the main
professional degree
· 7 years for the execution of the public execution functions of a higher
professional degree
Management positions
· 5 years for the public management positions of the head of the office, head
of service and general secretary of the commune, as well as of the specific
public functions equivalent to them
· 7 years for the public management position , other than those provided above
WHAT IS A CIVIL SERVANT?
The civil servant is the person
appointed, by an administrative act, according to the law, in a public
office.
What are the categories of civil
servants according to the level of attributions?
- senior civil servants
- management civil servants
- executing civil servants (grade: debutant /
assistant / principal / superior)
What is a debutant
civil servant? And a definitive civil servant?
There are named debutant civil servants:
· the persons who promoted the competition for the
occupation of a public position of professional beginner degree
· the persons named after the transformation of the
contractual positions until January 1, 2020 in positions related to the public
functions and that do not fulfil the seniority conditions in the specialized
field necessary for the performance of a definitive civil service function
There are named definitive civil
servants:
· the debutant civil servants who have completed the
period of training provided by law and have obtained the appropriate result
evaluation;
· persons who enter the body of civil servants by the
modalities stipulated by the law and who have the seniority in the specialty of
the studies necessary to occupy the civil service for a minimum of one year.
NOT ALL STATE EMPLOYEES ARE CIVIL SERVANTS! WHO IS NOT A CIVIL SERVANT?
- contracted personnel
employed in the own apparatus of public authorities and institutions, which
carry out secretarial, administrative, protocol, management, maintenance-repair
and servicing activities, guarding, as well as other categories of personnel who
do not exercise prerogatives of public power
- the
personnel employed in the cabinet of the dignitary

magistrates, the staff assimilated to them and, as the case may be, auxiliary
personnel categories in the courts
- teachers
and other staff categories in educational units and institutions;
- persons appointed or elected to public dignity
positions
- staff in health units - staff of autonomous administrations,
companies and national companies, as well as 18 companies in the sector8
- military personnel
- members of the diplomatic and consular corps of
Romania and contract staff assigned to specific functions of the ministry with
responsibilities in the field of foreign affairs
