Civil Service Reserve Body

WHAT IS THE RESERVE BODY?
The reserve body consists of civil servants who have been released from public office under certain conditions and is managed by the National Agency of Civil Servants. 

WHEN DOES A CIVIL SEVANT  ENTERS THE RESERVE?

- the public authority or institution ceased its activity under the conditions of the law, and its powers and personnel were not taken over by another public authority or institution
- the public authority or institution has been moved to another locality, and the civil servant does not agree to follow it
- the public authority or institution reduces its staff as a result of the reorganization of the activity, by reducing the position occupied by the civil servant
- as a result of the admission of the request for reintegration into the civil service occupied by the civil servant of a civil servant released or dismissed illegally or for unfounded reasons, from the date of the definitive stay of the court decision ordering the reintegration;
- the civil servant no longer fulfils one of the conditions:
· Of studies and seniority in the specialty provided by law for the occupation of public office
· Specific, according to the job description, for the occupation of the civil service
- the civil servant does not obtain the approval / authorization provided by law, if one of the specific conditions according to the job description, for the occupation of the public function is established and obtaining an opinion / authorization
- as a result of the unfounded refusal of the high civil servant to stop mobility

WHEN DOES A CIVIL SEVANT  EXITS THE RESERVE BODY?

Civil servants leave the reserve and lose the status of civil servant in the following situations:
- after the expiration of the term of 2 years from the date of passage in the reserve body
- in case the National Agency of Civil Servants redistributes it to an appropriate vacant civil service, and the civil servant refuses it
- at the completion of 12 months from the date of employment on the basis of an individual employment contract, as well as in any other form of pursuit of a profession or activity, under the conditions expressly provided by law
- at the request of the civil servant
- at the time of intervention of a case of lawful termination of the civil servant's service relations
