HOW CAN I TRANSFER?

HOW MANY TYPES OF TRANSFER ARE THERE?

- in the interest of the service 
- at the request of the civil servant

WHICH FUNCTIONS CAN I TRANSFER TO?

-to a vacant public post at the same level, subject to compliance with the category, grade and professional grade of the civil servant
- a vacant public post at a lower level


- for an executive civil servant: a civil servant in a grade lower than the professional grade of the civil servant's grade or lower level
- for managerial civil servants: a managerial civil servant in a hierarchical grade lower than the civil servant's grade of the civil servant's function, and any executive civil servant.

WHAT ARE THE CONDITIONS FOR TRANSFER?

- the civil servant being transferred must have the education, seniority and specific conditions required for the public service to which he/she is to be transferred
- the head of the public authority or institution to which the civil servant is being transferred shall verify the conditions of the transfer

INFORMATION ON TRANSFER IN THE INTEREST OF THE SERVICE:

- at the request of the head of the public authority or institution where the civil servant is to work
- with the written agreement of the civil servant
- with the approval of the head of the public authority or institution to which the official is appointed
- in the case of transfer in the interest of the service to a place other than that in which the authority or public institution from which the transfer is made has its headquarters, the civil servant transferred shall be entitled to:
    - an allowance equal to the net salary calculated at the level of the salary in the month preceding that to which he is transferred
    - paid leave of 5 working days
    - the payment of these entitlements shall be borne by the public authority or public institution to which the transfer is made, within a maximum of 15 days from the date of approval of the transfer
    - civil servants whose place of residence is in the locality in which the public authority or institution to which they are transferred has its headquarters shall not be entitled to the allowance.

INFORMATION ON TRANSFER ON REQUEST:

- at the request of the civil servant
- with the approval of the head of the public authority or institution where the civil servant is to work
- the authority or public institution within which the transfer on request of the civil servant has been approved shall promptly notify the authority or public institution within which the civil servant is employed of the approval of the request for transfer
- within a maximum of 10 working days of receipt of the notification, the head of the authority or public institution in which the civil servant is employed shall issue the administrative act amending the civil servant's employment relationships, specifying the date from which the transfer on request takes effect
- the date from which the transfer on request takes effect may not exceed 30 calendar days from the date of issue of the administrative act.

The public authorities or institutions may approve internal procedures for the selection of civil servants by transfer and for verifying the conditions for carrying out the transfer.
